NTSB Recommends Ignition Interlock

The National Transportation Safety Board has endorsed the Ignition Interlock technology and recognized its effectiveness.  Although 17 states already require ignition interlock, including Kansas and Nebraska, the NTSB recommends all states adopt a similar policy.  The effectiveness of our product is gaining national attention and continuing to save lives on a wider scale every year!  Below is the press release.

NTSB Recommends Ignition Interlocks for All First-Time DWI Offenders and Endorses Development of Passive Alcohol-Detection Technology

WASHINGTON – In its study on wrong-way driving crashes adopted today, the National Transportation Safety Board cited alcohol-impaired driving as the leading cause of these collisions and recommended that all first-offender alcohol-impaired drivers be required to have ignition interlocks installed on their personal vehicles.

“The first step to address the number one killer on our roadways is to do what is proven to be effective – use interlocks for all DWI offenders,” said NTSB Chairman Deborah A.P. Hersman.

An alcohol-ignition interlock is a device that prevents the engine from starting until a breath sample has been provided, analyzed for alcohol content and determined to be lower than prescribed limits. Currently, only 17 states require interlocks for first-time offenders.

The NTSB also strongly endorsed the continued development of a passive alcohol-detection technology. The Driver Alcohol Detection System for Safety (DADSS) would prevent alcohol-impaired individuals from operating their vehicles by detecting alcohol in the driver’s system through breath- and touch-based sensors.

“Technology is the game changer in reducing alcohol-related crashes on our nation’s roadways,” Hersman said. “Achieving zero alcohol-impaired driving-related deaths is possible only if society is willing to separate the impaired driver from the driving task.”

The study found that of the approximately 260 fatal wrong-way collisions that occur each year in the United States, most happened at night and on the weekends, and were in the lane closest to the median. In addition to reducing the number of alcohol-impaired drivers on the road, recommended mitigation efforts to prevent wrong-way accidents include better lighting, enhanced signage and roadway markings, and GPS devices that could provide a warning to alert drivers of wrong-way movements.

And, because older drivers are over-represented in wrong-way collisions, the NTSB asked all states to implement a comprehensive older driver safety program modeled on the one developed by the National Highway Traffic Safety Administration.

The NTSB issued 16 safety recommendations as a result of the special investigation report on fatal wrong-way driving crashes on limited-access highways. The study included data from NHTSA, recent research on this safety issue and a review of nine wrong-way collisions investigated by the NTSB that occurred in California, Colorado, Kentucky, Nevada, Pennsylvania, Texas, Virginia and Wisconsin.

Four Time DUI Offender Injures Two in Head-On

Justin Crawford, a Lawrence resident, was driving on the wrong side of the road at speeds approximated at 60 mph.  He then hit an unsuspecting car head-on sending both Crawford and a victim to the hospital.  This was all taking place at 2:15 p.m., not to mention that he already had at least three prior offenses. While I do not know all the details of this particular mans situation, I do know that previous offenses are a warning sign of future offenses.  Every fourth offense means that the individual was not deterred from the punishment or treatment from the first offense, second offense or third offense.  One thing in the midst of treating the offender that we know does work is Ignition Interlock devices.  While there will never be a perfect solution we have found that since Kansas passed first offender Ignition Interlock laws we have seen a reduction in alcohol related fatalities of 56%.  This is a MAJOR reduction and lower than any of the previous ten years.  And DUI arrests decreased by approximately 4000 offenses.  There is definitely something to these numbers.  Obviously it was too late to benefit Mr. Crawford, but there will be other Mr. Crawford’s in the future and we have to do our best to prevent them from injuring or killing more people.

So, what is the solution?  Until we can find a treatment or a way to eliminate someone from driving any vehicle after a DUI offense, we need to allow those who have a DUI to continue to work and drive because we all know that public transit is non-existent at best in Kansas.  We also need to monitor their driving, ,maybe even a work your way off program where an individual can prove over time that they are ready to drive without an ignition interlock device on their vehicle.  Interlock devices have made leaps and bounds in the past couple of years.  They can now capture a picture of the person blowing into it, determine if they have been drinking, tell the GPS location of the vehicle they are in and submit it real-time to authorities.  All for a cost much lower than having an individual in jail.  Ignition Interlock devices need to be installed for every offense, and for longer periods of time.  There has to be sanctions for having alcohol related events or the program will not be taken seriously.  Program times should be increased as the individuals prove through positive readings that they are not yet ready to have it removed.

So we will keep plugging along and hopefully keep making improvements that protect not only the public but those who have trouble with alcoholism.  We have made progress over the years as shown by the Huge decreases in deaths, but we can do more.

Supreme Court Deciding on Forced Blood Draw

It appears that the Supreme Court will hear arguments for and against forced blood draw when arrested for a DUI.  The court will determine if a warrant is required to do such given the speed at which alcohol dissipates from the blood.  Kansas considered this during the past two years of legislation but it gained very little traction with all the potential complications that it adds to the process.   We will see if that changes after the Supreme Court hears the case.  Read more about this story here.

Top 5 Must Know Kansas Ignition Interlock DMV Tips

What do I need to do to satisfy the Kansas DMV Ignition Interlock requirement?  This is a tricky question to answer.  Or at least one with many different pieces to answer.  I will do  my best to touch on the areas of most concern.

 

1.   You Can Apply To Drive During Suspension.
Many people do not know that they can continue to drive their vehicle during the suspension period.  All you must do is apply to the DMV after you have served at least 45 days of your suspension (30 on some) and pay a $100 application fee.  As long as your license is not suspended for other reasons that a DUI you will be approved to drive as long as you have an approved Kansas Ignition Interlock device installed.

2.    Don’t Wait To Have The Interlock Installed
We hear from people all the time that wait after their restriction to Ignition Interlock period begins to have the interlock installed.  Many think that they can wait out the period or that if they wait to have it installed it will make that period shorter.  NOT TRUE.  You must have the interlock installed on your car for the full restriction time period that the state requires.  This will not decrease or go away, until you proved that you have had it for the full-time you will not get your license back.  The DMV makes no “exceptions” because of not knowing how it works.  They simply require that you provide proof that you installed and serviced an approved device for the full restriction period.  This period begins when you provide proof of installation.

3.    Don’t Lose Your State Paperwork
You will need to keep your copies of your state paperwork during your Kansas required Ignition Interlock period.  This along with a copy of your “Installation/Removal Verification Form” will become your driver’s license during the period you have the Ignition Interlock on your vehicle.  You will want to make sure that you have your address current with the Kansas DMV so you get all the paperwork during this period.  Otherwise you will have to request additional copies that take time and money to receive.

4.  Choose An Approved Ignition Interlock Company Wisely

Kansas Ignition Interlock Law: First Year Results

The new Kansas Ignition Interlock Law that began July 1, 2011 has now been on the books for a year.  Now that the smoke has settled on the new legislation many want to know whether the two years of DUI Commission study and hard-fought debates over the law were worth it.  I believe the verdict is in, and a very positive one.

While there is no way to predict the future, experiences that other states around the country can be a very good predictor, as well as statistics from other Ignition Interlock programs.  Kansas is also now showing the same glowing results of having Ignition Interlock devices on ALL Kansas DUI’s.

Kansas has averaged 116 alcohol related fatalities per year between 2000 – 2010.  Kansas has had 125 and 137 respectively over the last two years.  This left us plenty of room for improvement as we were one of the worst states in terms of increased alcohol related fatalities.  But that has turned around in the correct direction now.  We are on the right track.

During the first full year of the new Kansas Ignition Interlock law Kansas saw a much lower total of 59 alcohol related fatalities.  This is decrease over the previous year of 56%.  This is a decrease over the 2000 – 2010 average of 49%.  This is a remarkable decrease during year one of the new legislation.  This may be one of the most dramatic decreases that have been seen yet with Ignition Interlock laws around the country.

Although this is preliminary data from the Kansas Department of Transportation they do not expect these numbers to change much, if any.  Thanks to all the hard work of the DUI Commission, House and Senate members, MADD, KIIA and all other active parties involved in making this piece of legislation happen.  There are approximately 75 families that did not have to suffer losing a loved one this year because of the hard work that you have done.

Kansas DUI Test Refusal

Kansas SB60, or Senate Bill 60, was passed and will go into effect on July 1st, 2012.  This bill covers many technical cleanup items that address changes to SB6 from last year.

New provisions to 8-1014, which outlines the administrative penalties for test failure, test refusals and failed test at .15 and above, have also been added.  This area that deals with Ignition Interlock penalties and how they apply to you will be outlined below.  If you have questions over the criminal side of the law please feel free to contact us for questions and we will do our best to point you in the right direction.  We are familiar with the statute and can answer most of your DUI questions for administrative and criminal penalties.

Change to K.S.A. 8-1014 are outlined below.

DUI Test Refusal – (All Ignition Interlock periods on 1st – 4th offense add 1 year.)

(1) On the person’s first occurrence, suspend the person’s driving
privileges for one year and at the end of the suspension, restrict the
person’s driving privileges for one year two years to driving only a motor
vehicle equipped with an ignition interlock device;
(2) on the person’s second occurrence, suspend the person’s driving
privileges for one year and at the end of the suspension, restrict the
person’s driving privileges for two three years to driving only a motor
vehicle equipped with an ignition interlock device;
(3) on the person’s third occurrence, suspend the person’s driving
privileges for one year and at the end of the suspension, restrict the
person’s driving privileges for three four years to driving only a motor
vehicle equipped with an ignition interlock device;
(4) on the person’s fourth occurrence, suspend the person’s driving
privileges for one year and at the end of the suspension, restrict the
person’s driving privileges for four five years to driving only a motor ve-
hicle equipped with an ignition interlock device; and
(5) on the person’s fifth or subsequent occurrence, suspend the per-
son’s driving privileges for one year and at the end of the suspension,
restrict the person’s driving privileges for 10 years to driving only a motor
vehicle equipped with an ignition interlock device.

Kansas DUI Under the age of 21 – (Removed wording that allowed lighter penalty)

(c) Except as provided by subsection (e) and K.S.A. 8-2,142, and
amendments thereto, if a person who is less than 21 years of age fails a
test or has an alcohol or drug-related conviction in this state, the division
shall:
(1) On the person’s first occurrence, suspend the person’s driving
privileges for one year. If the person’s blood or breath alcohol concen-
tration is .15 or greater, the division shall at the end of the suspension,
restrict the person’s driving privileges for one year to driving only a motor
vehicle equipped with an ignition interlock device;

(2) on the person’s second and subsequent occurrences,penalties shall be imposed pursuant to subsection (b).  

 

 

This section eliminates the distinction between those who are over the age of 21 and receive a test refusal, test failure or high-test failure (>.15).  This makes it so the penalties for all age groups are consistent and those under 21 will still be required to have a Kansas Certified Ignition Interlock device for a defined time period before a full unrestricted Kansas Driver’s License will be reinstated.  This has to be used in conjunction with the correct paperwork that we can help you fill out and complete.
